The Official Solicitor is an independent statutory office holder. His work is challenging, varied, sensitive, of great importance to his clients and some is high profile.

He has a number of functions including acting as litigation friend of last resort for individuals who lack mental capacity to conduct proceedings in the Court of Protection. In acting as litigation friend in such proceedings, the Official Solicitor must make decisions for his clients in their best interests in accordance with the principles of the Mental Capacity Act 2005.

Court of Protection: Property and Affairs Lawyer

This specialist role will see you acting as a litigation friend and solicitor in proceedings relating to property and affairs in the Court of Protection for persons lacking capacity. Always acting in the best interests of the client, you will be involved in applications relating to statutory wills, gifts and settlements and tax planning. Empathetic with a social conscience, you will bring experience of private client work, Mental Capacity Act 2005 and the Court of Protection Rules and Practice. Qualified to practice as a solicitor or barrister in England and Wales, you will ideally have advocacy experience.
