Appointed Person under the Proceeds of Crime Act 2002

Location: Negotiable (possible home working)

Time commitment: The expected time commitment is 10-15 days per year

Remuneration: £477 per day, (reviewed annually)

Could you provide independent oversight to the Government on the use of search and seizure powers by law enforcement agencies?

The Home Office, Scottish Ministers and Department of Justice in Northern Ireland want to appoint an independent person, who will provide oversight and scrutiny of reports of the use of certain search and seizure powers contained in the Proceeds of Crime Act 2002. You would play an important role in providing reassurance to Her Majesty’s Government, the Devolved Administrations and the public, that the search and seizure powers are being used effectively and proportionately. Reporting annually to Parliament, the Scottish Parliament and the Northern Ireland Assembly in this tri-partite role, you would also make recommendations on future developments, including new provisions contained in the Criminal Finances Act.

The statutory functions of the Appointed Person under the Proceeds of Crime Act 2002 are stipulated within the legislation. The Appointed Person is required to write annual reports for the Secretary of State, Scottish Ministers and Department of Justice in Northern Ireland to be laid before the parliament and Northern Ireland Assembly, drawing general conclusions about matters reported to them and making appropriate recommendations. They also have a role in providing recommendations on future development of the framework of the operation of the powers.

We are seeking candidates who have knowledge of search and seizure powers legislation and the need for it, how it is applied operationally and its effect on people and communities. You would also need familiarity with, or willingness to learn about, related provisions in Human Rights legislation, the history and purposes of relevant legislation in England and Wales, Scotland and Northern Ireland and appreciation of the legal differences in the three jurisdictions. Key personal attributes we are seeking are the ability to build strong working relationships and effective communication.

This position is offered as a three year fixed term appointment.
