Job Details

The role of the Healthcare Lawyer is to support the Head of Legal Services in the provision of a dedicated in-house legal service, which includes the following:

  • Healthcare advice: including but not limited to consent, capacity, data protection, Mental Health Act and regulatory proceedings, for both adults and children.
  • Disclosure requests: assisting the police and local authority on childcare and criminal proceedings, where the Trust may not be a party to proceedings.
  • Claims: management of Clinical Negligence and Third Party Claims, in line with NHSR’s schemes.
  • Inquests: support and representation of staff in the Coroner’s Court.
  • Training: internal training on above core areas of work.

Key aspects of the role:

We are looking for a Lawyer who shares our passion to support staff in the delivery of outstanding healthcare and represents the Trusts values to achieve that aim.

They will be required to undertake the following duties:

  1. Provide specialist legal advice to staff on all areas of healthcare law, often on an urgent basis, recognising the need for a pragmatic approach and displaying emotional resilience.
  2. Advise specifically upon queries relating to capacity, in line with the Mental Capacity Act 2005, and manage Applications to the Court of Protection with direct instruction to counsel.
  3. Reporting: analyse advice recorded on DATIX to the Head of Legal Services to report on the added value through managing advice in house and trends on such advice.  Utilise this information to recommend additional training requirements across the Trust.
  4. Childcare: Lead on queries arising from childcare proceedings, for example representing the interests of the Trust and clinician by challenging a request for expert opinion on an urgent emergency protection order.
  5. Relationships: Further develop relationship established with safeguarding team and patient safety leads to identify areas of training to support the Divisions. Engender an excellent working relationship with local authorities and police to achieve a common aim. Act flexibly in the provision of support to the Legal Services Team.
  6. Project: Responsibility for a project, such as a childcare forum to prepare staff for giving evidence in such proceedings.
  7. Training: provide training to all levels of clinical staff from ward based up to large conferences.

Management and legal support function

  1. Support the Head of Legal Services and Deputy Head of Legal Services in the provision of a well-run and efficient Legal Services Department
  2. Assist with the supervision and management of junior members of staff.
  3. Accept delegated responsibility for the management of statutory and mandatory training for the Legal Services Team.
  4. Assist the Head of Legal Services with a SOP/policy on the provision of healthcare law to staff.

    Health and Safety

Under the provisions contained in the Health and Safety at Work Act 1974, it is the duty of every employee to:

  • Take reasonable care of themselves and for others at work
  • To co-operate with the Trust as far as is necessary to enable them to carry out their legal duty
  • Not to intentionally or recklessly interfere with anything provided including personal protective equipment for Health and Safety or welfare at work.

Senior Management is responsible for the implementation throughout the Trust of suitable arrangements to ensure the health, safety and welfare of all employees at work and the health and safety of other persons who may be affected by their activities.  Where health and safety matters cannot be resolved at Senior Management level the appropriate Executive Director must be notified.

Line Managers are responsible for the health and safety management of all activities, areas and staff under their control.  This includes responsibility for ensuring risk assessments are completed and implementation of suitable and sufficient control measures put in place.  Health and safety issues are dealt with at the lowest level of management practicable.  Where health and safety matters cannot be resolved at a particular management level the appropriate Senior Manager must be notified.

Everyone has a responsibility for contributing to the reduction of infections.

It is the responsibility of all staff to respect the confidentiality of patients and staff, as specified in the Caldicott Principles, Data Protection Act and the Human Rights Act.  It is the duty of every employee to:

  • Only access person identifiable information as required in the execution of their duties.
  • Disclose information appropriately, in line with the Data Protection Act 1998.
  • To ensure good quality data by recording, promptly and accurately, clinical and non-clinical information within agreed timescales to PAS, the health record or the appropriate clinical or non-clinical information system
  • Always trace patient notes on the Patient Administration System
  • Maintain the confidentiality of their password / username and if in possession of a ‘Smartcard’ abiding by the terms and conditions of its use.
