The Official Solicitor is an independent statutory office holder. His work is challenging, varied, sensitive, of great importance to his clients and some is high profile.
He has a number of functions including acting as litigation friend of last resort for individuals who lack mental capacity to conduct proceedings across the family and civil courts in England and Wales. In acting as litigation friend in such proceedings, the Official Solicitor must make decisions for his clients in their best interests and in accordance with the principles of the Mental Capacity Act 2005.
Civil Litigation Lawyer
You will take charge of the supervision and case management of a broad range of civil cases in the high court and county court. Acting as a litigation friend for vulnerable members of society, including children and those lacking capacity, you will appoint solicitors to act on behalf of clients and supervise cases being managed by the team of lay case managers. Cases will include, but not be limited to, clinical negligence, personal injury, landlord and tenant, Human Rights Act and Inheritance Act claims.
It’s an excellent opportunity to join a collaborative and supportive team. As the Official Solicitor is committed to ensuring flexibility of his resources, you may also be expected to take on cases in other jurisdictions, primarily the Court of Protection. So the role will enable you to expand your experience and knowledge.
Qualified to practise as a solicitor or barrister in England and Wales, you will be known for your social conscience. Your broad legal skills and expertise will ideally include some experience of working in the voluntary sector. You’ll also bring an understanding of the Mental Health Act. Above all, you’ll be keen to gain exposure to other areas of the law and relish the scope for progression within our organisation.
