Job Details

Key Responsibilities:

  • To conduct a caseload of Claimant Clinical Negligence matters (including complex and or high value matters) on behalf of clients as directed and in accordance with the Firm’s file management and supervisory policy. To ensure that a focussed and detailed approach is taken to conducting claims. All new cases taken on by the candidate must be vetted by a Designated Partner in the team prior to instructions being accepted by the Fee Earner on behalf of the Firm. All work (at least initially) will be carried out in accordance with your supervisors agreed case plan. Whilst working on the files it is essential that the client is updated in respect of progress and the costs implications of their case on a regular basis. Files must be conducted with appropriate speed whilst achieving the best possible results for the client. The candidate will be expected to maximize the Firm’s costs whilst conducting files. The Fee Earner will be set challenging targets in respect of Costs and WIP (and others introduced from time to time) which must be reached.
  • To advise on strategy, tactics and how best to achieve the most successful outcome for each client according to the particular circumstances of their case.
  • To maintain a diary and bring up entries in accordance with the firms procedures.
  • To work with a case management system, databases and normal office IT systems.
  • Detailed knowledge of relevant forms and procedures.
  • Compliance with procedures set out in the office manual, professional standards and any requirement set by the Legal Aid Agency or similar interested bodies e.g. Legal Expense Insurers.
  • To contribute towards the development of the Department and Firm. To include preparation of articles for external newsletter and attendance marketing and social events. To identify and pursue your own marketing initiatives and those agreed upon with your supervisor.
  • To assist in the audit of files run by potential target Firms.
  • Compliance within SRA and other regulatory frameworks including but not limited to Money Laundering Procedures and the Data Protection Act
  • Participation in the development, marketing and success of the PI Department
  • Maintains and develops communication between other fee earners, staff and representatives from own function/division and wider Simpson Millar group
  • Builds and grows links to external organisations
  • Case supervision of more junior staff though this is not line management responsibility.

Experience, Knowledge & Qualifications:

  • NQ to 4 years’ experience of running a clinical negligence caseload.
  • Admitted Solicitor or Legal Executive or equivalent.
  • Good people management skills, including ability to lead, supervise and mentor both individuals and teams successfully. Ability to maintain and develop existing relationships and to develop new relationships with trade unions and other work sources.
  • Excellent knowledge and understanding of clinical negligence work, including complex and/or high value matters.
  • Good track record of achieving consistently high levels of billing and time recording, taking into account the level of expertise required.
  • Excellent knowledge and understanding of all relevant forms, procedures and protocols.
  • Substantial Experience in handling multi-track/catastrophic litigated work.
  • Good practical skills, including proven negotiation and advocacy skills.
  • An ability to deal with clients and colleagues in a sensitive, professional and competent way.
  • An ability to work on your own initiative within a team environment to achieve results.
  • An ability to vet and convert leads into cases.
  • Excellent IT skills, which include the ability to work with a case management system, databases and normal office IT systems.
  • Empathy and good listening skills.
  • A friendly and co-operative approach to clients.
  • Excellent organisational skills.
  • Ability to work flexibly.
  • Ability to work to strict deadlines.

Desirable:

  • An awareness of the procedural requirements of the Legal Aid Agency.
  • Experience in Court of Protection work.
  • Good track record of effective involvement in marketing activities.
  • Ability to contribute to business planning and strategy.
  • Member of Law Society Clinical Negligence or AvMA referral Panel.
  • Accredited by Legal 500 or Chambers.
