UK NOMINATION TO THE EUROPEAN NUCLEAR ENERGY TRIBUNAL

The Department of Business, Energy and Industrial Strategy (BEIS) invites Expressions of Interest to be considered as the UK’s nominee to be a judge on the European Nuclear Energy Tribunal (ENET) for the next mandate of the Tribunal. This Expression of Interest is in respect of nomination only, as the appointment of nominees as judges is governed by the Council of the Organisation for Economic Co-operation and Development (OECD).

The ENET was set up by the Convention on the Establishment of a Security Control in the Field of Nuclear Energy. The ENET’s jurisdiction is strictly limited to resolving disputes between the contracting parties to the 1960 Paris Convention on Third Party Liability in the Field of Nuclear Energy and the 1963 Brussels Convention Supplementary to the Paris Convention, concerning the interpretation or application of those conventions.  

To date, the ENET has never heard a case and the judges’ duties has been limited to attendance at an inaugural session.

The full nomination criteria can be found at the link below. Consistent with its intended interpretation those criteria, BEIS invites Expressions of Interest from applicants who are:

  • Individuals who satisfy the conditions for appointment
    - to the High Court, Court of Appeal or Supreme Court, or the equivalents in Northern Ireland, and who satisfy the judicial appointment eligibility of continued engagement in legal matters over a 7 year period, or
    - as a judge of the Court of Session in Scotland, or
  • Individuals with (7 or more years) experience (including in academia and research) in nuclear third party liability law and/or international law.

The appointment period is 1 January 2020 to 31 December 2024. The OECD Council is responsible for the terms and conditions of the appointment. Appointed judges are considered as OECD Council Experts while performing their duties and are paid fees and expenses.
