We are a friendly specialist legal aid practice with a national reputation located near London Bridge. We advise and represent disabled people in welfare and hybrid proceedings under the Mental Capacity Act in the Court of Protection as well as advising in community care law. We are regularly instructed by the Official Solicitor. We have contracts with the Legal Aid Agency in community care and public law and are Lexcel accredited.

We are seeking a full time solicitor (2 + years PQE) to join our mental capacity team to work alongside Nicola Mackintosh QC (Hon) and our trainees undertaking complex and strategic casework in the Court of Protection.

You will preferably have experience in health and welfare cases in the Court of Protection and be a current legal aid supervisor or be eligible to meet the supervisor requirements in either community care or public law or both.

What is most important is your drive and hunger for the work that we do. We will also consider candidates who show they have transferable skills, want a challenge and would like to take their career in a different and exciting direction. We will provide the support to make that happen.

Established in 2011, this niche firm has a national reputation for specialising in mental capacity welfare casework in the Court of Protection. Mackintosh Law act for disabled individuals and/or their family members carers and advocates. Nicola Mackintosh QC (Hon) was initially Sole Director and was joined by Co-Director, Zena Soormally Bolwig in June 2020.

The firm is regularly instructed by the Official Solicitor to the Senior Courts, advocacy agencies and lay individuals in vulnerable adult protection cases, challenges to deprivation of liberty under the Mental Capacity Act and other health and welfare and property and affairs cases in the Court of Protection which frequently raise complex and novel issues. 

Casework includes the protection of disabled adults at risk of abuse or neglect, mental capacity regarding a range of issues including, but not limited to questions of capacity and best interests in relation to medical treatment, sexual relations, marriage, contact, use of the internet/social media, and travel. Our cases involve statutory agencies and family members in complex legal and factual disputes, often resulting in complex and lengthy fact findings hearings. In addition, the firm conducts casework in community care, health and mental health law (excluding mental health tribunal representation), advising clients with disabilities (adults and children) and their carers regarding their entitlement to assessments and services from local authorities and NHS agencies.  

Most, if not all of the cases conducted by the firm include human rights and civil liberties issues including under the Human Rights Act (the right to liberty, life, a fair trial, private and family life to marry, the right not to be discriminated against), The Equality Act and the Convention on the Rights of Persons with Disabilities. Those fundamental rights underlie many of the issues faced by our clients who either lack capacity in specific areas or are seeking to protect the rights of their family or loved ones who lack capacity in that way. Nearly all of our cases also raise healthcare, including mental health healthcare issues, as a result the intrinsic overlap between the Mental capacity Act and the Mental Health Act, particularly in DOLS cases and cases involving disputes between statutory agencies. The firm’s work seeks to raise the profile of the legal rights of people with disabilities, including learning disabilities, as well as those living with conditions such as autism, dementia and many other life-long conditions. We also act for those in mental distress and clients with physical disabilities.  

 The firm holds a contract with the Legal Aid Agency to undertake legal aid work and the team, led by Nicola Mackintosh and Zena Soormally Bolwig, are staunch campaigners for access to justice for disabled people. We have taken some of the leading test cases in our field and have a national reputation for quality advice and representation which is second to none. Our reputation is acknowledged by the judiciary, other fellow professionals and those working on behalf of disabled people who need expert skilled legal representation.
