Job description

The primary responsibility and function of this role is trial advocacy in the Crown Court, which will include advocacy in effective trials and non-contested hearings. It is therefore a requirement that the post holder already holds (or must hold by 31 December 2020) their respective Professional Regulator’s (BSB or SRA) Higher Rights of Audience for criminal advocacy accreditation to fulfill this role.

Subject to the post holder satisfying the “general qualification” provision within the meaning of section 71 of the Courts and Legal Services Act 1990, the post is designated by the Director of Public Prosecutions as a Crown Prosecutor under the terms of section 1 (3) of the Prosecution of Offences Act 1985.

Responsibilities

•The primary responsibility and function of this role is trial advocacy in the Crown Court, which will include advocacy in effective trials and non-contested hearings. In addition the postholder will also conduct first hearings in magistrates’ court and case management hearings (PTPHs) in the Crown Court.’ court cases and straight forward Crown Court cases as defined by the CPS Graduated Fee Scheme.

•To analyse, review, prepare and prosecute a wide range of cases, except for the small amount of very weighty casework received, and are expected to have up-to-date knowledge of criminal offences ranging from motoring to murder. To advise in all magistrates’ court cases and a range of Crown Court cases.

•To draft responses to Parliamentary Questions (PQs) and to prepare high level oral and written briefings for the DPP and Law Officers.

•To demonstrate a high level of oral and written communication skills in all matters relating to the prosecution of serious, complex or sensitive cases.

•To deal effectively and persuasively with a wide range of people, both internally and externally, as part of a multi-skilled team or individually in order to ensure the effective and successful prosecution of cases.

•To proactively lead and manage a team to ensure that case deadlines and priorities are met. Seeking continuous improvement by assessing and sharing lessons learnt with others. To work collaboratively with other agencies on either case specific or wider criminal justice system issues.

•To adapt quickly to the demands of the case, working without supervision and under pressure.
To be flexible in working hours, be able to build and manage prosecution case teams, ensuring that momentum in case preparation is maintained and demonstrate consistency of decision making, integrity and discretion. The postholder must be able to demonstrate a proven ability to be able to work quickly and accurately when under immediate pressure
