Responsibilities

The States of Guernsey are seeking to appoint an Asset Recovery and Mutual Legal Assistance Lawyer to join the team at the Law Officers of the Crown.

The Office of Her Majesty's Procureur is the central authority for the Bailiwick of Guernsey in relation to matters of international co-operation and mutual legal assistance. Both Law Officers of the Crown and staff responsible to them discharge various public functions and provide a range of legal services in order to support and respond to international requests for assistance and related activities. They provide advice and assistance to other jurisdictions in relation to the investigation and prosecution of crime, including the tracing, freezing and recovery of the proceeds of crime, and provide similar advice and assistance in relation to non-conviction based civil forfeiture.

A lawyer is required to assist with the provision of legal advice and assistance in matters relating to asset recovery and mutual legal assistance, and to support the Law Officers in the discharge of their international obligations. The post holder will be required to review and advise upon incoming applications for the tracing, restraint and forfeiture of the proceeds of crime, including the preparation of court applications and related documentation. Working with others in Chambers, they will provide legal advice and assistance to Bailiwick law enforcement officers in connection with the tracing of assets, and the obtaining of evidence in international requests predominantly relating to financial crime. The post holder may also be required to assist in relation to domestic, non-conviction based civil forfeiture proceedings and applications.

Some travel may be required where necessary. The post holder will be expected to perform a representational role at recognised international groups, such as CARIN, for which Guernsey is currently a member of the Steering Group.

Whilst the post holder is expected to be engaged primarily on matters relating to international co-operation, mutual legal assistance, and asset recovery, he or she is expected to engage, from time to time, with other work within Chambers which may include civil litigation and advisory work. There may also be occasions when the post holder will be expected to assist with the provision of other functions (including constitutional functions) carried out by the Law Officers and their professional staff.
