Let us tell you a little bit about the role....

The Care Quality Commission (“CQC”) is the regulator for health and social care services in England.

The CQC’s Litigation, Prosecutions, and Inquests (“LPI”) Team is recruiting a Senior Lawyer within its Civil Team. The work of the Civil Team involves conduct of First Tier Tribunal (“FTT”) and Upper Tribunal (“UT”) appeals.

The Civil Team specialises in the conduct of appeal litigation arising from CQC civil enforcement decisions. At their busiest the team handle internally between 60 - 80 appeals.  The team currently consists of 2 Senior Lawyers, 2 Lawyers, 1 Legal Officer, and 4 paralegals (a resource shared with the LPI Criminal Team).  The team hold a weekly meeting to discuss recent case developments, identify training needs and ensure shared learning in respect of relevant case law and legislation.

Senior Lawyers have significant experience as advocates and have so far represented CQC at hearings in urgent FTT hearings and before the UT. They also take conduct of Judicial Review proceedings (“JR”).

The role involves supporting the Legal Manager and managing and supporting the Civil Team in its day to day functions and ongoing development. Senior Lawyers handle complex cases and directly line manage and provide strategic direction to members of the team.

Senior Lawyers within the Civil Team also make a wider corporate contribution in terms of helping to develop CQC legal priorities, identifying trends and feeding back to Directorates.
