The Independent Monitoring Authority for the Citizens’ Rights Agreements (“the IMA”) is an independent body that makes sure the rights of EU and EEA EFTA citizens living in the UK and Gibraltar are upheld following the departure of the UK from the EU. The IMA is responsible for promoting and monitoring the implementation and application of the citizens’ rights commitments made in Part 2 of the Withdrawal Agreement and Part 2 of the EEA EFTA Separation Agreement (“the Agreements”).

The responsibilities of the IMA are set out in Schedule 2 to the European Union (Withdrawal Agreement) Act 2020, but in summary, the IMA will seek to achieve its objectives by:

  • monitoring and keeping under review the legal framework and the exercise of functions by relevant public bodies in relation to relevant rights*;
  • conducting inquiries;
  • producing reports and recommendations to which relevant public authorities must have regard; and
  • where appropriate, issuing or intervening in legal proceedings.

Purpose of the post

The successful applicant will work within a current team of 5 lawyers (comprising 2 Senior Legal Advisers and 3 Legal Advisers) within the Legal Directorate of the Independent Monitoring Authority, reporting to the IMA General Counsel.

The IMA Legal Directorate provide legal advice to the Board, Executive Team, Operational Delivery Directorate and Governance Corporate Services Directorate of the IMA. The successful applicant can expect to advise on all aspects of the IMA’s work, including in relation to inquiries, litigation, complaints in addition to contribution to the provision of training. They will also be expected to develop relationships with colleagues from across the IMA as well as a variety of other public authorities and stakeholders.

You will also be responsible for working with external legal service providers and counsel when required, under the direction and oversight of the General Counsel.

Within these areas of responsibility, the successful applicant may be allocated specific areas of responsibility. As Legal Advisers, the successful applicant will have support from Senior Legal Adviser colleagues in the team, in particular on more complex and new areas of legal issues and questions.

Essential Skills

You will be

  • a qualified barrister or solicitor entitled to practise in England and Wales. We will consider applications from trainees who are due to qualify in or around March 2022.

And you will be able to demonstrate the following:

  • An understanding of the main features of public and administrative law,
  • Sound legal judgement including the effective management of legal risk,
  • Sound powers of analysis and the ability to provide legal advice on complex and technical areas of law,
  • Experience of working with and communicating complex legal issues to and influencing senior stakeholders.
